Terms of Use

Welcome to the Tittles & Bits website, an AKM LLC store. Using this website and its related services, products, and software (collectively, the "Site"), you agree to be bound by our Conditions of Use and Terms & Conditions.  Additional or separate terms may apply to your interactions with other AKM LLC websites. To the extent that the provisions of any additional terms conflict with these Conditions of Use, the provisions of the additional terms will govern.  References to "Tittles & Bits," "our," "we," or "us" may refer to Tittles & Bits or AKM LLC, their affiliates, subsidiaries, and designees. We may make changes to the Site and the Conditions of Use and Terms & Conditions. It is your responsibility to review these for updates or changes; if you do not agree with the Conditions of Use or Terms & Conditions, you should not use the Site.

We will not be liable for anything beyond product sales price, including indirect, incidental, special, or consequential loss or damage, or other claims for compensation arising directly or indirectly.  You agree to defend, indemnify, and hold Tittles & Bits and AKM LLC harmless from and against all claims, damages, costs, and expenses, including reasonable attorney fees, arising from or related to your use of this site.  We do not warranty or endorse any products.

Access and use of this site confirms agreement to be bound by the Terms and Conditions, and Security and Privacy policies, which may be modified, without notice.  New Terms & Conditions and policies become effective upon posting.

We accept the following forms of payment:  PayPal, Visa, Master Card, American Express, and Discover Card.  No credit card or payment information is processed, recorded, or maintained outside of the payment processor's system.  We do not have access to your credit card number or account information unless you provide it directly to us for us to place an order vs. customer entered (never email credit card information).

Payment may be declined if additional information is desired to validate the user.  If we reject, limit, or otherwise modify your order, we will attempt to notify you using the e-mail address you provide to us. If we cancel an order or part of an order that we've already charged you for, we'll refund you the full amount of the canceled portion of the order; all refunds must be applied to the same card against which purchases were made.  We reserve the right to cancel any account or order without notice and at our sole discretion, for any reason we deem appropriate.  In the event of an order rejection or cancellation, AKM LLC, DBA Tittles & Bits, has no legal liability or obligation to the Buyer.  

We verify all payment addresses and phone numbers as part of the payment authorization, and retain the right to dispute all chargebacks.  If we lose a disputed chargeback we will attempt to collect the disputed charge plus the chargeback fee directly from the customer.  If the amount is not paid within the required 30 days, we will report the non-payment to the three credit bureaus and may file a civil lawsuit in small claims court in the state in which our business is headquartered for the disputed amount, chargeback fee, and court costs.

Our order confirmation to you does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. At any time after receipt of your order, we may accept, decline, or place quantity or other limits on your order for any reason. We may impose these limits on a per-person, per-household, per-order, or any other basis.  

You may not use digital coupons toward the purchase of gift cards.  Lost and stolen gift cards can't be replaced if lost or stolen.  All credit card charges will list the name AKM LLC, and may not include the name Tittles & Bits on your credit card statement.  Placing an order acknowledges your responsibility to pay all credit card charges for the order, whether under the name Tittles & Bits, AKM LLC, or both.

Some items are offered at sale or discounted prices for limited periods of time, and on specific merchandise. These sale / discounted prices are not applicable to purchases made outside the sale / discount period of time. Some items are marked final sale, and are not able to be returned or exchanged. 

This site could inadvertently include technical, typographical, or photographic errors - we do not warrant that all information is 100% accurate and complete. Due to computer and monitor differences the colors of some items may vary slightly - 100% color accuracy is not guaranteed. We do honor returns per our Return Policy for avoidable product misrepresentations.  If incorrect prices are posted we may elect to decline the order.  We reserve the right to amend errors and update product information at any time without notice.  All advertised prices are exclusive of applicable sales tax, shipping charges, and customs or other fees. If an order is shipped outside of the United States the Buyer assumes full responsibility for any additional shipping, customs, and other fees; and any delivery delays or issues. Any delivery dates are estimates only. We are required to collect applicable sales tax on all orders shipped to addresses in Virginia.  We are required to collect applicable sales tax on some items shipped outside of Virginia, depending on the location of the shipping warehouse location. Sales taxes are based on the final purchase amount, which does not include shipping, but does, by law, include gift wrapping.

We are not a manufacturer, and do not provide product warranties.  Any product warranties are the sole responsibility of the manufacturer; most products carry no warranty by the manufacturer.  We offer no verbal or written guarantees or warranties of any kind concerning the accuracy of product information or the quality and durability of products, beyond the scope of our written Return Policy. Any implied or specific product descriptions made on this site about products and their usage are based on manufacturer and public information, advertising, and reviews, and do not constitute any AKM LLC or Tittles & Bits guarantees or warranties.

Your placement of an order, and receipt of electronic confirmation, does not guarantee an order. All products on our site are offered while supplies last, and all prices are in USA currency. It is possible that we may not be able to supply a requested item in the quantity ordered or within our advertised timeframe; if this is the case we will let you know as soon as possible.   We do not charge your credit card for a product until that product is ready for shipment (during order confirmation we do perform a pre-authorization on credit cards).

We provide all order confirmations and updates via e-mail - it is important that each order provides a correct email, and that the email is checked daily by the customer for order updates and questions.  We do not sell or give away your email.

It is the customer’s responsibility to ensure that products purchased are applicable and safe for any purpose used, that products are age appropriate to the users, and to obtain additional information as needed to make those decisions. 

Many items sold in the United States are imported from China and other countries.  If the manufacturing country is of concern to you and is not listed, or additional information is desired on material content, please contact us at CustomerService@TittlesandBits.com.

All items shipped have the Tittles & Bits name, address, store website, and phone number on the shipping label, and on the enclosed packing slip.  We do not include prices on the packing slips (the prices are listed in the invoice emailed following order submittal).  We occasionally receive requests to drop ship items - we are not a wholesaler, and do not provide drop shipping services.

Unless we separately give you permission, in writing, you may not copy, scrape, frame, modify, remove, delete, augment, add to, publish, transmit, participate in the transfer or sale, lease or rental of, create derivative works from, or in any way exploit any of the Content, in whole or in part. Permission is granted to download product information for non-commercial, temporary use only - no other permission is granted. Any use of our site and information for any business/commercial use is prohibited, unless AKM LLC grants such permission in a signed, notarized contract. The Tittles & Bits logos and trademarks on the Site are the property of their respective owners.

Our Reward program helps our customers accumulate points towards future purchase discounts by earning points for orders, referral of new customers who place an order, and social media referrals.  This program is subject to termination at any time without notice, and any points accumulated at that time will be lost.

This site is intended for use by customers in the contiguous United States, Hawaii, Alaska, Puerto Rico, and the USA Virgin Islands. Requests for orders to other countries must be requested via e-mail; we do not guarantee orders will be accepted for shipment to other countries, and we are not responsible for customs approval or any customs or fees, duties, or taxes for any items.
